New York State Annual Performance Report

 What Parents Need To Know

Under IDEA 2004 states are required to develop a six-year, 2005-2010, State Performance Plan.   

New York has set targets and performance measures on three special education monitoring priorities:

*Free appropriate public education in the least restrictive environment (Indicators 1-8)

*Disproportionality (Indicators 9-10)

*Effective general supervision (Indicators 11-20)

• The State Performance Plan is designed to evaluate New York's efforts to implement the requirements and purposes of IDEA and describe how the State will improve its implementation.

• Each year the state must report to US Department of Education Office of Special Education and Rehabilitative Services (OSERS) on the progress and slippage through the publication of an Annual Performance Report. OSERS then reviews the annual performance report submitted by the state and makes an overall determination rating. In June New York state received a determination of "needs assistance" for school year 2008-009 for Indicator 11 ( timely initial evaluations), indicator 12 (IEP developed and implemented by third birthday), and Indicator 17 (due process hearing timelines). With this determination New York State must seek technical assistance and report to OSEP by October 1, 2010 how the technical assistance is addressing the factors contributing to the ongoing noncompliance.
