Special Education: Know Your Rights!

New York Lawyers for the Public Interest (NYLPI) provides essential tools to successfully navigate the special education system in NYC to ensure that children with special needs receive the educational services to which they are entitled regardless of the type of school—public, charter, or private.

You will leave knowing 1) the basics of special education rights and procedures, including the least restrictive environment requirement, functional behavioral assessments / behavior intervention plans, and the IEP meeting, 2) how to obtain and use independent educational evaluations—and what to do when you encounter roadblocks, 3) the rights of students with disabilities who attend charter schools—and tips for parents and guardians considering these schools, 4) your rights and practical options as students transition from high school to life after high school, 5) how to advocate for your child who has experienced abuse, harassment, or mistreatment by school staff or contractors in the NYC Department of Education, such as how to file a complaint, your right to information and participation about any incident, investigation, or follow-up, and a student’s right to be protected from harm during and after an investigation, and 6) your right to language interpretation at school meetings and to translated educational documents, so you can enhance your participation in your child’s education.
